Terms and Conditions of My Jewel Club by TOMEI Group

Please read the following Terms and Conditions (“Terms”) carefully before accessing or using the site. By accessing, using or visiting our site and/or participating in the My Jewel Club by TOMEI Group (“said Program”), you agree to be bound by the Terms and all other terms, policies, notices, guidelines published at  https://myjewelclub.com/ as the case may be incorporated by reference.

These terms apply to all terms of the site, including without limitation users who are browsers, customers, merchants and/or contributors of content.

  1. SCOPE AND APPLICATION

1.1. The said Program is operated by TOMEI CONSOLIDATED BERHAD of No. 8-1, Jalan 2/131A Project Jaya Estate, Batu 6 Jalan Kelang Lama 58200 Kuala Lumpur Malaysia (“TOMEI”, “we”, “us” or “our”).

1.2 Eligibility of members

(a) Individuals who are at least 18 years of age and residing in Malaysia are qualified to be members of the said Program. By signing up and joining the said Program, you confirm that you have met all the qualifications as stated in these Terms.

(b The membership of the said Program is intended for personal use and not transferable. For the avoidance of doubt, commercial use of the membership of the said Program such as purchasing agents, corporate individuals, partnerships and/or associations are prohibited.

(c) Employees of TOMEI and its subsidiary companies are ineligible to apply for or join the membership of the said Program.

(d) We may in our sole discretion refuse any applications at any time if we consider fit.

1.3 We reserve the rights to change, modify, insert and/or delete all or any portion of these Terms, as well as any policies, notices, guidelines pertaining to the said Program at any time at our sole discretion. Any such changes and/or modification to the Terms will be effective immediately upon publication on our website at https://myjewelclub.com/.

1.4 You should read these Terms and applicable policies, notices, guidelines from time to time to stay informed and understand the same. In the event you do not agree to the revised and/or modified Terms, as well as policies, notices, guidelines thereof, you may exercise your right of termination under Clause 6.1 within fourteen (14) days from the date of publication thereof. In the event you do not exercise your right of termination under Clause 6.1, you shall be deemed to have agreed to such revision and modification.

1.5 Effective from 15th March 2024, the qualified existing members of “Jewel Club” will be converted and migrated into “My Jewel Club by TOMEI Group” membership subject to the members’ express acceptance on the said Terms, policies, notices, guidelines pertaining to the said Program.

  1. JOINING MY JEWEL CLUB BY TOMEI GROUP

2.1 For new applications to the said Program, you may sign up and join the said Program after making a purchase of products (excluding repair services, replacement of parts, or purchase of gift cards etc.) at any retail outlets of TOMEI, GOLDHEART, Signature By TOMEI and Le Lumiere in Malaysia (“Participating Stores”).

2.2 No application fee or renewal fee will be imposed by us.

2.3 We will review your application form and your personal details upon receipt thereof. If your application is accepted by us, we will notify you via the email provided in your application form and assign personal membership number to you. The date of our notification email shall be deemed as your official joining date of My Jewel Club by TOMEI Group (“Joining Date”).

2.4 We will not issue membership card to you but you can check your membership details, reward points and make online redemption by creating your personal account at https://myjewelclub.com/  using the following steps:-

(a) You may log in to https://myjewelclub.com/  for the first time using your NRIC number/ passport number (whichever is applicable) as the username. The default password for first time log in has been set as ‘Tomei@’ followed by last four (4) digit of your NRIC number/ passport number (whichever is applicable);

(b) Upon your initial log in, it is mandatory to change your password and fill-in your personal and contact details accurately. We shall not be responsible for any security breaches resulting from your failure to change your default password or for any loss of eligible rewards of the said Program due to your failure to provide and/or update your personal and contact details.

(c) In the event of you forgetting a password, you can choose one of the following options for resetting it:-

            (i) click on the “forgot password” icon on the login page; or

            (ii) send an email to enquiry@myjewelclub.com; or

            (iii) visit any of the Participating Stores for assistance.

2.6 If necessary, we will communicate with you via electronic communications (including email and SMS).

  1. MEMBERSHIP TIERS

3.1 My Jewel Club by TOMEI Group consists of three (3) tier levels depending on the minimum spending amount that you accumulate in your account within one (1) year from your Joining Date. These tiers are as follows:-

3.2 By signing up and joining My Jewel Club by TOMEI Group for any purchase less than RM40,000.00 from Joining Date, you will be enrolled automatically in “Diamond” tier. In general, each tier membership is valid for two (2) years from your date of enrolment into a particular tier (“said Cycle”). To maintain the same tier benefits after the expiration of the said Cycle, you must reach the minimum spending amount per year required for that tier within the subsequent Cycle as specified in Table 1 above.

3.3 The upgrading of tier level is possible in the following circumstances:-

(a) If you spend more than RM40,000.00 and less than RM99,999.99 within the said Cycle, you will be upgraded to “Ruby” tier starting from the next day of the last accumulated transactions which exceeds RM40,000.00; and

(b) If you spend more than RM100,000.00 within the said Cycle, you will be upgraded to “Emerald” tier starting from the next day of the last accumulated transactions which exceeds RM100,000.00;

(c) Once your tier level is upgraded, your said Cycle will be refreshed, recalculated and extended from the date of your tier level upgrade for another two (2) years; and

(d) You can view and track your membership tier level and detailed benefits or rewards at https://myjewelclub.com/.

3.4 If you do not reach the minimum spending amount required for your tier within the subsequent Cycle, as specified in Table 1 above, your tier level will be downgraded to the respective tier corresponding to your spending amount. However, your tier level will be upgraded again upon meeting the minimum spending amount as specified in Table 1 above.

3.5 If you do not make any purchase within the said Cycle, your membership will be deactivated upon expiration of the said Cycle (“said Deactivation”). In the event of any subsequent purchase after the said Deactivation, your membership will be reactivated on the next day of your purchase and will be valid for the following two years (“said Reactivation”), unless there is an adjustment due to the upgrading of your membership.

3.6 Before making a payment at Participating Stores, it’s necessary to present your identity card or passport to the cashier. This allows the cashier to record the spending amount into your personal account.

3.7 If you return any purchased product, the purchase amount for those returned products will be deducted from the total spending accumulated in your My Jewel Club by TOMEI Group account. Consequently, your tier level may be adjusted accordingly.

3.8 The books and records kept by us shall constitute conclusive evidence of any facts or events relied upon by us in accordance with any payment into the membership, redemption or any dealings in relation to the membership of My Jewel Club by TOMEI Group.

3.9 We reserve the rights to change or increase the minimum spending value required for the membership tiers, reward or changing rewards or eliminate any tier benefits at our sole discretion.

  1. REDEMPTION OF REWARD POINTS

4.1 When making certain purchases at our Participating Stores, you have the opportunity to earn reward points accumulated to your tier level, subject to our approval and discretion. The collection of points are as follows:-

4.2 However, the purchase of the following products are excluded from collection of points:
(a) Gold Bar;

(b) Gold Water;

(c) Gold Coin;

(d) Silver Bar;

(e) ISEE2;

(f) Lumiere Star Items and Certified GIA Diamonds; or

(g) other products which we may include herein from time to time at our discretion.

4.3 Further to Clause 4.1 above, in the event the points collected are converted into decimal places, only the whole figure will be taken into account without rounding up the decimal places.

4.4 The rewarded points will be reflected at your personal account at https://myjewelclub.com/ and will be valid for two (2) years from the date of purchase of such products. You are advised to redeem your reward points before the expiry date. Your failure to do so will result in the forfeiture of these points, and we will not be held responsible for any such loss.

4.5 During the collection or redemption of points, you must present you identity card or passport for identity verification purpose, and we may require to make copies of the same, to which you hereby consent. In the event that a member is unable to provide the same, the member’s name and mobile telephone number will be required to verify the validity of membership.

4.6 We reserve the right to deduct an administration fee equivalent to 5000 reward points for any redemption made manually at the Participating Stores.

4.7 Further to Clause 3.8 above, we reserve the right to refuse the redemption of any reward points or deduct the balance of a member’s reward points if such reward points are suspected of being fraudulently recorded or accumulated or have been recorded by error or mistake.

  1. MEMBERS’ OBLIGATIONS

5.1 The tier benefits you are entitled to or eligible for are not transferable.

5.2 You are solely responsible for any damages resulting from any fraudulent misuse of your membership number or personal account, caused directly or indirectly by you.

5.3 You are required to provide and maintain accurate and complete information regarding your membership details, including but not limited to your contact information such as email, telephone number and address. Failure to maintain updated information may result in the inability to enjoy your tier benefits, for which you are solely responsible.

  1. TERMINATION

6.1 You may terminate your My Jewel Club by TOMEI Group membership at any time by contacting us at enquiry@myjewelclub.com. Immediately upon termination, your personal account, membership tier benefits and other related elements will be cancelled.

6.2 We reserve the right to terminate your membership without prior notice at our sole discretion for good cause, which includes, but is not limited to, your breach of the Terms, your provision of false data to us or your misuse, fraudulent procurement, or use of your membership.

  1. LIMITATION OF LIABILITY

7.1 We shall not be liable to any person, with respect to the said Program, to the fullest extent permitted by law, for any:

(a) act or omission;

(b) loss or damage that is not foreseeable;

(c) indirect or consequential loss or damage;

(d) interruption, deletion, omission, defect, failure, or issues related to any equipment, electronic transmission, software or programming utilised by the member, for any inability to access any website or online service, or for any other technical or non-technical error or malfunction for whatever reason; and

(e) human error; and

(f) events beyond our control.

  1. PERSONAL DATA PROTECTION 

8.1 We ensure that the collection, use, and disclosure of your personal data comply with the Malaysian Personal Data Protection Act 2010 (‘PDPA’) and applicable Privacy Laws in each operating jurisdiction.   1. PROMOTIONAL UPDATES

9.1 Upon signing up for My Jewel Club by TOMEI Group, you have consented to receive promotional updates from us via email and/or SMS.

  1. MISCELLANEOUS

10.1 The Terms are governed by the laws of Malaysia. Any dispute shall be under the exclusive jurisdiction of the Malaysian courts.

10.2 If any provision of the Terms is deemed illegal, invalid, or unenforceable, it will be removed, and the remaining terms will remain in effect.

10.3 The waiver of any provisions must be explicitly stated in writing. Failure to exercise any right or remedy shall not constitute as a waiver by TOMEI.

10.4  All intellectual property associated with the said Program, including setup, accounts, benefits, rewards, and points, remains the property of TOMEI.
